1. Service Provider Information

PromptScout is operated by:

These Terms of Service (the "Terms") govern your access to and use of the PromptScout platform and services. By accessing or using PromptScout, you agree to be bound by these Terms and our Privacy Policy. These Terms comply with Polish law, including the Act on Providing Services by Electronic Means (Ustawa o świadczeniu usług drogą elektroniczną), the Consumer Rights Act (Ustawa o prawach konsumenta), and applicable EU regulations.

2. Description of Service

PromptScout provides AI visibility monitoring services ("Service") that enable you to:

• Track how AI assistants (ChatGPT, Gemini, Google AI Overview) mention your brand in their responses
• Monitor competitor visibility across AI platforms
• Analyze trends and receive visibility reports
• Configure custom prompts and receive citation alerts
• View competitive intelligence including competitor mention frequency and positioning
• Analyze which sources AI systems cite when responding to prompts
• Generate AI-powered strategic insights and recommendations (paid plans only)

The Service is provided on a subscription basis with different tiers offering varying features and usage limits as described on our Pricing page.

3. Technical Requirements

To use PromptScout, you need:

• A modern web browser (Chrome, Firefox, Safari, Edge - latest two versions supported)
• Stable internet connection
• JavaScript enabled
• Valid email address for account creation and communications

4. Account Registration

To access our Service, you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription Plans and Pricing

5.1 Available Plans

We offer a free trial and four subscription tiers:

• Free (Forever free): Up to 5 prompts, 1 monitor run (one-time), access to 2 AI providers (ChatGPT, Gemini), manual monitoring only. AI-powered insights, weekly reports, and citation alerts are not included.
• Starter ($15/month): Up to 15 prompts, weekly monitoring frequency, unlimited monitor runs, all 3 AI providers (ChatGPT, Gemini, Google AI Overview), AI-powered insights, weekly reports, and citation alerts.
• Growth ($39/month): Up to 30 prompts, every 3 days monitoring frequency, unlimited monitor runs, all 3 AI providers, AI-powered insights, weekly reports, and citation alerts.
• Pro ($99/month): Up to 50 prompts, daily monitoring frequency, unlimited monitor runs, all 3 AI providers, AI-powered insights, weekly reports, and citation alerts.
• Agency (Custom pricing): Unlimited prompts, unlimited monitoring frequency, all 3 AI providers, all features, and dedicated support.

5.2 Billing

Subscriptions are billed in advance on a monthly basis. Pricing is displayed in USD and converted to your local currency by our payment processor. VAT/tax is added where applicable based on your location.

If a payment fails, your account enters a "past due" status where you retain read-only access to your existing data but cannot create new prompts, run monitors, or use AI-powered features until payment is resolved. You can update your payment method in your account settings at any time.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You will be charged the then-current subscription price. We will notify you of any price changes at least 30 days before they take effect, and you must actively consent to the new price before it applies (as required by Polish consumer protection law).

6. Right of Withdrawal (Cooling-Off Period)

Under EU Consumer Rights Directive 2011/83/EU and Polish Consumer Rights Act (Ustawa o prawach konsumenta), if you are a consumer (an individual acting outside your trade, business, craft, or profession), you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days from the day of concluding the contract (i.e., from when you completed your subscription purchase).

6.1 How to Exercise Withdrawal

To exercise your right of withdrawal, you must inform us of your decision by a clear statement sent to lukasz@promptscout.app. You may use the following template:

6.2 Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive notice of your withdrawal. Reimbursement will be made using the same payment method used for the initial transaction.

6.3 Exception for Digital Services

If you request the Service to begin immediately during the withdrawal period, and you acknowledge that you will lose your right to withdraw once the Service has been fully provided, you may be charged proportionally for the service provided up to the time you communicated your withdrawal. By starting to use the Service immediately after purchase, you expressly consent to begin the service and acknowledge you may lose your withdrawal right.

7. Refund Policy

Beyond the statutory right of withdrawal:

• Within 14 days of purchase: Full refund available under right of withdrawal (see Section 6).
• After 14 days: Refunds are handled on a case-by-case basis at our discretion. Contact us with your concerns.
• Cancellation mid-cycle: If you cancel your subscription, you will retain access until the end of your current billing period. No partial refunds for unused time after the withdrawal period.

7.1 How to Request a Refund

All refund requests should first be directed to us at lukasz@promptscout.app. You can find our contact email on the bottom of your purchase receipt.

If you are unable to resolve the issue with us directly, you may contact our payment processor, Creem, for further assistance at creem.io/contact.

7.2 Unrecognized Charges

If you have questions about a charge you don't recognize, or you have noticed an issue with one of your payments, you can contact Creem at creem.io/contact and they will investigate on your behalf.

8. Cancellation

You may cancel your subscription at any time through your account settings, via the Creem order management portal, or by contacting us. Please note that cancelling your subscription means you will lose access to paid features at the end of your current billing period. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• No further charges will be made after the current period
• You can export your data before your access ends
• After the billing period ends, your account will be downgraded to the Free tier with limited functionality (5 prompts, 1 monitor run (one-time), 2 AI providers)
• Your existing data (monitors, prompts, historical results) remains accessible but you cannot exceed Free tier limits on new resources

9. AI-Powered Features

PromptScout offers AI-powered insights that analyze your visibility data and generate strategic recommendations. This feature:

• Uses OpenAI's language models to process aggregated data about your brand's visibility, competitor mentions, and source citations
• Sends only summarized statistics (mention counts, source names, competitor names) to OpenAI - not raw AI response texts or personal data
• Stores generated insights in your account for your reference
• Is available only on paid subscription plans

The recommendations provided are informational and do not constitute business, legal, or marketing advice. Results may vary and you should independently verify any strategic decisions.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers) to access the Service
• Resell, sublicense, or redistribute the Service without our written permission
• Upload or transmit malicious code or harmful content
• Violate the rights of others, including intellectual property rights

Violation of these terms may result in immediate account suspension or termination without refund.

11. Intellectual Property

All content, features, and functionality of PromptScout, including but not limited to software, text, graphics, logos, and design, are owned by PromptScout and protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data and content you provide to the Service. By using the Service, you grant us a limited license to process your data solely for providing the Service to you.

12. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with reasonable advance notice
• Modify features or functionality to improve the Service
• Temporarily suspend service for technical reasons
• Discontinue features with 30 days' notice where possible

13. Limitation of Liability

To the maximum extent permitted by applicable law:

• PromptScout is provided "as is" without warranties of any kind, express or implied
• We do not guarantee the accuracy, completeness, or reliability of AI response data we collect
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

These limitations do not apply where prohibited by law, including mandatory consumer protection laws in the EU and Poland.

14. Complaint Procedure

If you have a complaint about our Service, please contact us at lukasz@promptscout.app with:

• Your name and contact information
• Description of the issue
• Date the issue occurred
• Your proposed resolution

We will acknowledge your complaint within 3 business days and aim to resolve it within 14 days.

As an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to Terms

We may modify these Terms from time to time. When we make material changes:

• We will notify you by email at least 14 days before changes take effect
• The updated Terms will be posted on this page with a new "Last updated" date
• Continued use of the Service after the changes take effect constitutes acceptance
• If you do not agree to the new Terms, you may cancel your subscription

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Poland, without regard to conflict of law provisions. For business users, disputes shall be resolved by the courts of Poland.

If you are a consumer resident in the EU, you may also bring proceedings in your country of residence, and you benefit from mandatory provisions of consumer protection law in your country that cannot be waived by contract.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
